Housing as a Disability Rights Issue

Access to safe, affordable, and accessible housing is a fundamental right — yet it remains one of the greatest unmet needs in the disability community. Long waiting lists for housing vouchers, a shortage of accessible units, and persistent discrimination combine to create a housing crisis for many individuals with disabilities.

Your Fair Housing Rights

The Fair Housing Act and Section 504 of the Rehabilitation Act prohibit housing discrimination based on disability. Key protections include:

  • The right to request reasonable accommodations in rules or policies
  • The right to request reasonable modifications to the physical unit
  • Design and construction requirements for accessible features in newer buildings
  • Protection against discriminatory advertising, denial, or terms

Housing Options for People with Disabilities

The full spectrum of housing options includes independent living in private homes or apartments with or without supports, supported living arrangements with staff assistance, shared living or host family programs, and HUD-assisted housing including Section 8 vouchers and public housing.

Medicaid Waiver Housing Supports

Many states offer housing-related supports through Medicaid Home and Community-Based Services waivers, including assistance with deposits, utility setup, and ongoing tenancy support. Check with your state's Medicaid office or an advocacy organization to learn what is available in your area.

Advocacy Priorities

Advocates are pushing for increased funding for Section 8 housing vouchers, elimination of discriminatory zoning that blocks group homes, expansion of Money Follows the Person programs, and more robust enforcement of fair housing protections.
